Terms and Conditions
These General Terms and conditions ("Terms and Conditions") are applicable to any use of the website ("Website"), to any services or products available on the Website and to any and all offers, orders and agreements connected therewith ("Products").
The Terms and Conditions shall be applicable to all transactions and shall be in addition to the Terms of Use, available on the Website. In case of any inconsistency between the Terms and conditions and the Terms of Use, the Terms and Conditions shall prevail.
Article I General
You acknowledge and guarantee that by using the Products of the Website, you are at least 18 years of age or older. In the event that the legal age for smoking in your country is greater than 18 years of age, you must be at least the legal age of your country to purchase the products offered by this Website.
The Terms and Conditions contained herein constitute the entire Agreement between yourself and the Website.
The Website may change or withdraw any product on the Website at any time, without notice or any ongoing obligation.
Article 2 Use of Services
You hereby undertake to not use the Products for any illegal purpose whatsoever. It being clearly understood that it is an offence to supply anyone with any product which may be used on conjunction with an illegal substance and/or drug.
The Products provided under this Website are intended for consumption of tobacco or legal herbal smoking products or preparations only. It is understood that you will at all times abide by our country's (whether provincial, state or municipal) laws in regard to the use of the product.
This Website does not advocate the use of any illegal substance and you must be over 18 or the minimum age of smoking your country, whichever is greater, to visit this Website and purchase the Products.
Article 3 Payment
If you are making payment by credit card, you hereby verify that this card is valid and that in using the credit card you have the legal authority to make payment with the credit card for the Products. All credit card holders will be required to provide photo identification as well as any other verification for identification purposes as may be required by the Website. In the event that it is determined that the credit card is being used in a fraudulent and/or illegal manner, all information held by the Website will be immediately forwarded to the appropriate authorities with the relevant jurisdiction for prosecution.
All prices as seen on the Website are final. Any pricing error will result in delivery of the Products being suspended whereupon the appropriate adjustment will be made prior to delivery of the Product.
Article 4 Contractual Obligation
Any offer made by this Website is made without legal obligation as to price or delivery until such time as an order has been accepted by the Website and payment is made and confirmed. Only then will the Product be shipped to the customer. The Product remains the property of this Website until payment is received in full.
Article 5 Exchanges Delivery and Shipping
All shipping will occur within 30 days from the time that receipt of payment is confirmed, subject to Article 6. In circumstances where the Website is unable to deliver the Product within the referenced period of time, the customer is entitled to either an exchange of Product of equal value or a refund of the original monies paid in respect of that Product. The Website shall have no further obligation or liability to the customer with respect to a failed delivery.
Any and all returns of damaged Product is the responsibility of the customer. Any returns must be in the hands of the Website within 5 working days of receipt of the item. Only damaged or faulty items are eligible for return pursuant to these Terms and Conditions.
Accordingly, the risk of damage during transportation will be accepted by the Website provided the appropriate notification is provided (see above).
Article 6 Confiscation by Customs
In certain jurisdictions, Customs may open the package and elect to confiscate the Product.
In such circumstances, this Website shall not refund payment but upon proof of confiscation, this Website will resend the Product on a one time basis. This Website is not in a position to control or take responsibilities for the actions of any jurisdiction regarding Custom and Excise obligations. In the event that you are aware that use of the Product is illegal in your jurisdiction, you run the risk of having the Product confiscated. We urge you not to order a Product from this Website in these circumstances.
Article 7 Personal Information and Protection of Privacy
This Website will not share any information with any third party unless otherwise obligated by law. This Website will, however, share personal and/or financial information with the appropriate police authority in the event of fraud payment through the use of a stolen credit card or unauthorized use of credit cards in payment of the Product.
